Below is a sample of recent results I have achieved for my clients. My toolkit for achieving excellent results for my clients includes: aggressively pushing a case to trial or preliminary hearing after cutting down the prosecution’s case; filing various motions to dismiss or to suppress key evidence; moving for diversion under several recently-enacted programs; and presenting exculpatory and mitigating evidence after conducting extensive investigation. (Please note that results vary between cases and the results below were dependent on the facts of a specific case.)
Attempted Murder Charge Dismissed (Marin): homicide charge dismissed by court after prosecution failed to meet their burden at four-day preliminary hearing.
Robbery Case Dismissed (San Francisco): following filing of defendant’s California Electronic Communications Privacy Act motion to suppress evidence for a clear violation by the police, prosecution dismissed case on the day of the preliminary hearing.
Violation of Restraining Order Case Dismissed (Marin): Court sustained demurrer and dismissed case on the basis that the First Amendment had been violated by restraining order prohibiting client from publishing her domestic violence survivor blog. (See Marin Independent Journal article.)
Domestic Violence Case Dismissed (Marin): case dismissed by the prosecution at time of trial for lack of evidence after defense motion to exclude that evidence was granted.
Child Abuse Case Dismissed (Marin): case dismissed by the prosecution at time of trial for lack of evidence after defense motion to exclude that evidence was granted.
DUI Case Dismissed (San Francisco): client’s motion for judicial pretrial diversion was granted and case was dismissed after client completed diversion terms.
Domestic Violence Case Dismissed (Marin): felony case with allegation of great bodily injury dismissed by the prosecution at the preliminary hearing for lack of evidence.
Domestic Violence Case Dismissed (Marin): felony case dismissed by the prosecution at the preliminary hearing for lack of evidence.
San Quentin Drug Case (Marin): felony case dismissed following defense investigation showing narcotics did not belong to client.
Domestic Violence Case Dismissed (Alameda): case dismissed before trial following defense investigation.
Domestic Violence Case Dismissed (Marin): domestic violence charge dismissed by the prosecution at trial for lack of evidence; diversion granted on remaining resisting arrest charge.
Drug Sales Case Dismissed (Marin): felony case dismissed before preliminary hearing after defense investigation and follow-up laboratory tests exonerated client.
Restraining Order Violation Case Dismissed (San Francisco): after extensive briefing and hearings, client was granted mental health diversion, which he completed for a case dismissal.
Domestic Violence Case Dismissed (Lake): case dismissed before trial following defense investigation.
Criminal Threats and Dissuasion Case Dismissed (Marin): felony case dismissed before preliminary hearing following defense investigation.
Indecent Exposure Case Dismissed (Marin): after extensive briefing and hearings, client was granted mental health diversion, which he completed for a case dismissal; this case marked the first time that mental health diversion was granted in Marin for an indecent exposure charge, which normally requires sexual offender registration upon conviction.
Drug Sales Case Dismissed (San Francisco): Court granted defendant’s speedy trial motion, dismissing case.
Theft Case Dismissed (Marin): client was accepted into and completed diversion program for a case dismissal.
Vandalism Case Dismissed (San Francisco): case dismissed following defendant’s Penal Code §§ 1377-1378 motion for civil compromise.
Domestic Violence Case Dismissed (Solano): Court granted defendant’s speedy trial motion, dismissing case.
DUI Case Dismissed (Marin): case dismissed after Court granted defendant’s motion to suppress.
Contracting without a License Case Dismissed (Marin): client was accepted into and completed diversion program for a case dismissal.
Criminal Threats Case Dismissed (San Francisco): client was accepted into and completed diversion program for a case dismissal.
Theft Case Dismissed (Marin): case dismissed by Court after defense presented mitigation regarding client’s mental health disability and made Penal Code § 1385 motion to dismiss.
Battery Cases Dismissed (Marin): two cases dismissed for combat veteran after his acceptance into and completion of military diversion.
Possession of Child Pornography (San Francisco): following the filing of defendant’s California Electronic Communications Privacy Act motion seeking relief for a clear violation by the police, case dismissed before preliminary hearing.
Trespass and Resisting Arrest Case Dismissed (Marin): client accepted into diversion program.
Domestic Violence Court Order Violation Case Dismissed (Marin): client, a victim of charged domestic violence, was subsequently falsely accused by his abuser and charged with violating a court order; case dismissed by prosecution after defense’s presentation of mitigation evidence.
Theft Case Dismissed (Marin): client accepted into and completed diversion program for a case dismissal.
Assault with Firearm Causing Great Bodily Injury Case Pled Down (Marin): after defense’s presentation of exculpatory and mitigation evidence, client allowed to plead to felony gun possession and misdemeanors for probation in a case with exposure of 20 years state prison.
Robbery Charge Pled Down to Misdemeanor (Marin): client allowed to plead to a lesser misdemeanor charge after defense’s presentation of mitigation and immigration consequences.
Domestic Violence Case Pled Down to Disturbing the Peace (Alameda): after defense’s presentation of mitigation and collateral consequences, client allowed to plead to misdemeanor disturbing the peace for dismissal of numerous battery and criminal threats charges.
Residential Burglary and Criminal Threats Case Pled Down (Marin): client allowed to plead to aggravated trespass in case alleging two strikes; client also obtained early termination of probation.
Shooting Case Pled Down (Marin): client allowed to plead to misdemeanor after defense’s presentation of mitigation evidence.
Attempted Murder Case Pled Down (Marin): client allowed to plead to accessory charge after defendant’s presentation of exculpatory and mitigation evidence.
Residential Burglary Case Pled Down (Marin): client avoided strike and was allowed to plead to misdemeanors after defense’s presentation of exculpatory and mitigation evidence.
Drug Trafficking Case Pled Down (Marin): client, accused of trafficking large amounts of narcotics, was allowed to plead to accessory charge after defense’s presentation of exculpatory and mitigation evidence.
Possession of Stolen Property Case Pled Down (Sonoma): client allowed to plead to misdemeanor after defense’s presentation of mitigation evidence.
Domestic Violence Case Not Filed (Contra Costa): prosecution persuaded not to file domestic violence charges against Penal Code section 290 parolee with prior strike based on defense investigation showing that reporting party had fabricated allegations.
Child Endangerment Case Not Filed (Contra Costa): prosecution persuaded not to file child endangerment case after defense’s presentation of mitigation evidence.
Domestic Violence Case Not Filed (Marin): prosecution persuaded not to file domestic violence case after defense’s presentation of mitigation evidence.
